JUDGEMENT

(1.) THE petitioner has filed this writ petition challenging the letter dated 28.4.2012 issued by the Convener, Post Graduate (Medical) Selection Committee -2012 cum - Dean and Principal, M.K.C.G. Medical College, Berhampur, opposite party No. 3 in not publishing his result in respect of entrance test held for Post Graduate ((Medical) Selection, 2012, Odisha.

(2.) THE brief facts of the case are that the petitioner completed Bachelor of Medicine and Bachelor of Surgery in the Year 2007. He appeared All India Entrance Examination, 2011 for admission to M.D./M.S./Diploma/M.D.S. Courses conducted by All India Institute of Medical Science, New Delhi. he was selected for admission to MD (PREY. and SOC MED), Course at V.S.S. Medical College, Burla, However, as the petitioner was not able to get his choice subject, he again appeared the entrance test for Post Graduate (Medical) Selection 2012. Opposite parties 2 and 3 after proper scrutiny issued admit card in favour of the petitioner. He appeared the said entrance examination in the College of Agriculture O.U.A.T. Campus, Bhubaneshwar having Roll No. 4061. The result of the said examination was published on 26.3.2012. But, the result of the petitioner was not published. Therefore, he applied before opposite party No. 3 under Right to Information Act to intimate the reason for non -publication of his result while publishing the provisional list of candidate successful in the entrance test. Opposite Party No. 3 in his letter dated 28.4.2012 intimated to the petitioner that his result has not been published in the list as he is undergoing P.G. Course at V.S.S. Medical College, Burla. Hence this writ petition.

(3.) LEANED Counsel for the petitioner submitted that earlier one Prasanta Kumar Dash took admission in P.G. General Medicine in V.S.S. Medical College, Burla. However, he again appeared P.G. (Medical) Examination in the years 2010 and 2011 and got 157 and 419 ranks respectively. Similary one Susanta Kumar Pujhari also appeared P. G. (Medical) Entrance Examination in the years 2010 and 2011 and got 116 and 55 ranks respectively and their results were also published. However, the result of the petitioner has not been published.
