JUDGEMENT

(1.) <DJG>R .K.PATRA</DJG>, J. : - This application is an offshoot of the judgment dated 26 -2 -2002 passed by a Bench of this Court in the writ petition filed by the petitioner (vide OJC No. 10471 of 2001) (reported in 2003 Lab IC 33).

(2.) THE petitioner filed O. A. No. 2082(C) of 1999 before the Orissa Administrative Tribunal, Cuttack Bench, Cuttack praying for promotional benefits including promotion to O.A.S. Class -I(Senior Branch) with retrospective effect. As the Tribunal rejected the claim, he filed Writ Petition (OJC No. 10471 of 2001) in this Court. This Court by judgment dated 26 -2 -2002 (reported in 2003 Lab IC 33) allowed the writ petition by observing inter alia as follows :

(3.) IN view of this, there is substance in the grievance of the petitioner made in this application. There is also no point in remitting the matter to the Government for reconsideration.
