JUDGEMENT

(1.) The appellant, having been convicted under section 302 of the Penal Code and having been sentenced to undergo rigorous imprisonment for life, has preferred this appeal.

(2.) The case of the prosecution is that deceased Manjara Munda is the son of the first wife of the accused-appellant. The deceased was demanding share from his father's property for which there was ill-feeling between them. The deceased was living separately in another house with his family. It is alleged that on 24.5.1991 the deceased had gone to his father, the appellant, and he was killed by the appellant by shooting an arrow. After the deceased was killed, his dead body was thrown inside a well near the house of the appellant. After the incident the appellant disclosed about it before his co-villager Gunduri Munda and showed him the dead body of the deceased lying inside the well. The co-villagers marked both the hands of the deceased inside the well and the matter was informed to the Grama Rakshi and the Ward Member of the village. Thereafter the F.I.R. was lodged by one Indramani Dehury on the basis of which investigation was taken up and charge-sheet was filed.

(3.) The appellant denied the allegations made by the prosecution.
