JUDGEMENT

(1.) The appellant in this appeal assails the order dated 03.05.2019 passed by the learned District Judge, Mayurbhanj at Baripada in R.F.A. No.41 of 2016, whereby he dismissed the appeal on the ground of limitation.

At the outset, the position of law should be clarified with regard to maintainability of appeal under Section 100 of Code of Civil Procedure, 1908 (for short, 'the Code') against an order dismissing the appeal filed under Section 96 of the Code as a consequence of rejection of a petition for condonation of delay in filing the said appeal.
