JUDGEMENT

(1.) This revisional application under Sec. 115 of the Code of Civil Procedure is at the instance of a husband in a suit for divorce and is directed against Order No. 48 dated Nov. 11, 1997 passed by the learned Additional District Judge, 1st Court, Alipore in Matrimonial Suit No. 2 of 1993 thereby disposing of an application under Sec. 24 of the Hindu Marriage Act ("Act") by directing the present petitioner to pay a sum of Rs. 2,500.00 for the maintenance of the opposite party and the only child of the parties. By the said order, the petitioner was directed to pay further sum of Rs. 4,000.00 as litigation expenses.

(2.) In the year 1991, the opposite party brought a suit for divorce against the present petitioner on the ground of desertion and cruelty.

(3.) The said suit was subsequently transferred to the 1st Court of Additional District Judge, Alipore and was renumbered as Matrimonial Suit No. 2 of 1993.
