JUDGEMENT

(1.) A very interesting and crucial question comes up for consideration in this second appeal and which is a substantial question of law.

(2.) The plaintiff filed a suit for declaration of his right to conduct the sheba puja of the deity, Sri Sri Bura Shiva Thakur. There was also consequential relief prayed for that the principal defendants be restrained from disturbing the plaintiff's possession in the suit property and interfering with his functions in relation to the deity.

(3.) The learned trial court, who decided the Title Suit No. 25 of 1977 decreed the suit.
