JUDGEMENT

(1.) Challenge in this writ petition is thrown to the action of the State Respondents having their offices in the District of Birbhum and, more particularly the action of the Additional District Magistrate and District Land & Land Reforms Officer (ADM and DL&LRO), Birbhum, rejecting the claim of the petitioner to a Short Term Mining Lease (STML) and instructing the petitioner to participate in a Long Term Mining Lease (LTML) tender for extraction of sand.

The petitioner who, as a Tribal claims special rights to extraction of sand, submits through Mr. Milan Chandra Bhattacharya, Learned Senior Counsel, that he was originally granted a STML in respect of Plot No. 554, Mouza Dhanyagram II, Mayurakshi Division, District Birbhum (in short, the said Plot).

(3.) . It is submitted that the STML granted in 2011, upon compliance of necessary formalities by the petitioner, expired in 2014. The attention of this Court is drawn to a communication of the Revenue Inspector (the RI), Khatanga Gram Panchayet (GP), District Birbhum addressed to the respondent No.7, the Block Land & Land Reforms Officer (BL&LRO), Suri -1, Kalipur, District Birbhum.
