JUDGEMENT

(1.) This is an application challenging an order dated 27th Sept., 2018 passed by the learned Additional Sessions Judge, Fast Track, 3rd Court, Basirhat, North 24 Parganas, thereby closing the evidence and fixing date for recording of statement of the accused under tion 313 of the Code in connection with Sessions Trial case No. 40 (11) 09 under sections 302, 201 read with section 34 of the Penal Code.

(2.) Referring to the affidavits of service filed, it is submitted on behalf of the petitioner that pursuant to an earlier direction passed by this Court, the petitioner had twice tried to cause service of notice upon the opposite parties. It is further submitted that the private opposite parties refused to accept one such notice.

(3.) No one appears on behalf of the private opposite parties.
