JUDGEMENT

(1.) This appeal is directed against a judgement and order, dated June 11, 2014 passed by a learned single judge in WP 7441(W) of 2014.

(2.) Pursuant to an advertisement issued by the West Bengal College Service Commission ('the Commission', for short), the petitioner applied for the post of Assistant Professor in Physical Education. The qualification required for the post was a Master's degree with at least 55 per cent. marks or an equivalent grade or grade point in the same or relevant subject from a recognised university and a three-year Bachelor's degree. It was specifically mentioned that candidates who had been awarded Ph.D. degree in the same or relevant subject in accordance with the University Grants Commission (Minimum Standards and Procedure for Award of Ph.D. Degree) Regulations, 2009 ('the Regulations, 2009', for short) would be exempted from appearing in the eligibility test, i.e., NET, SLET, SET etc.

(3.) The grievance of the writ petitioner is that he was not allowed to participate in the selection process as he did not have the NET qualification. His contention is that since he has done his Ph.D. under the Regulations, 2009, he is entitled to get the exemption from having a NET qualification.
