JUDGEMENT

(1.) The appellant has challenged the judgement and order dated 04.05.1989 passed by the learned Special Court, E.C. Act, Murshidabad, in E.C. Case No. 37/87 (T.R. No. 127/87) wherein the learned trial court was pleased to convict the accused appellant under Section 7(i)(a)(ii) of the Essential Commodities Act of West Bengal Pulses Edible Oil Seeds and Edible Oils (Dealers Licensing) Orders and also para 3(2) of the West Bengal Declaration of Stocks and Prices of E.C. Order 1977 and sentencing the appellant to suffer R.I. for four months and also convicting the accused / appellant under section 8 of the West Bengal Anti Profiteering Act, 1958 and sentencing the appellant to pay a fine of Rs.250/- in default to suffer S.I. for fifteen days.

(2.) I find from the records of the case that the incident was of the year 1987 (16.06.1987) that is about 32 years.

(3.) Mr. De, the learned senior counsel appearing for the appellant submits that the prosecution evidence both oral and documentary are not sufficient to arrive at a conclusion of guilt so far as the present appellant is concenred.
