JUDGEMENT

(1.) This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved on the inaction of the respondent authorities granting compassionate appointment to him.

(2.) The case of the petitioner is that during the lifetime of his father, an application had been made by the father of the petitioner on the ground of incapacitation for compassionate appointment in his favour. The said application has been considered and recommended by the Sub-Divisional Controller, Food and Supplies, Krishnagar, Nadia and thereafter by the District Controller, Food and Supplies, Nadia and sent to the Director, District Distribution, Procurement and Supply, Government of West Bengal, for appointment of the petitioner on compassionate ground.

(3.) However, before the said approval could be granted by the Principal Secretary, Food and Supplies, Government of West Bengal, the petitioner's father expired. Upon death of the petitioner's father the petitioner once again made an application for compassionate appointment. Upon such application being made, the State authorities are seeking 'no objection' as per Clause 20(vi) of the West Bengal Public Distribution System, Maintenance and Control (Order), 2013.
