JUDGEMENT

(1.) Sonar Bangla Caterer is the common appellant in M.A.T. 1194 of 2019 and M.A.T. 1196 of 2019. While M.A.T. 1194 of 2019 has been carried from a judgment and order dated 7th August, 2019 passed by a learned Judge of this Court in W.P. 10893 (W) of 2019 (Sri Shibnath Ghosh Vs. The State of West Bengal and Ors.), M.A.T. 1196 of 2019 is an appeal directed against an order dated 9th July, 2019 passed by the selfsame learned Judge of this Court in W.P. 10897 (W) of 2019 (Milani Swanirbhar Gosthi vs. The State of West Bengal and Ors.). The appellant was the private respondent in both the appeals.

(2.) We shall refer to the contents of the orders under appeal after completion of the factual narrative.

By a notice dated 9th October, 2018, the Chief Medical Officer of Health, Murshidabad (hereafter 'the CMOH') invited bids for supply of cooked diet for the patients of various hospitals in the district of Murshidabad. Berhampore Mental Hospital (hereafter the said hospital) was one of such hospitals for which bids had been invited.
