JUDGEMENT

(1.) Question of law and fact involved in this case are common and identical with that of the writ petition being W.P. No.11280(W) of 2018. Show-cause notice being Annexure "P-11", Order or suspension being Annexure "P-13" issued by (Prof.) Dr. Sumanta Bhattacharyya, Principal, HETC and the order of termination dated 23rd March, 2018, issued by respondent no.6, in this case are identical with those in W.P. No.11280(W) of 2018. Since I have set aside the entire proceeding right from the issuance of the show-cause notice to the order of termination, the issues involved in this writ petition are also governed by the judgment and order dated May 16, 2019 in W.P. No.11280(W) of 2018 in Dr. Sankar Prasad Mukherjee Vs. Maulana Abul Kalam Ajad University & Ors.

(2.) Accordingly, the order of show-cause dated 12.09.2017, order of suspension dated 20.09.2017 and the order of termination dated 22.09.2017, issued by (Prof.) Dr. Sumanta Bhattacharyya, Principal, HETC, are set aside and quashed.

(3.) The writ petition, accordingly, succeeds and allowed.
