JUDGEMENT

(1.) Indian Museum Kolkata published an advertisement in the year 2012 inviting applications for appointment in the post of Education Officer. In the advertisement it was mentioned that there was only one vacancy and the same was unreserved. The petitioner applied for the said post.

(2.) The Board of Trustees of the Indian Museum held a meeting on 23rd December, 2013. Agenda No.5 of the said meeting was to consider ratification of the approval and sanction accorded by the Chairman to the appointment of the Education Officer. It was recorded that the members were informed that on the recommendations of the Selection Committee constituted as per the Recruitment Rules with His Excellency the Governor of West Bengal as Chairman, the petitioner has been appointed as Education Officer on regular basis with the approval of the Chairman subject to the ratification of the Board.

(3.) In response to a query from the Joint Secretary, the functions of the Education Officer, Indian Museum was explained. The Board of Trustees thereafter, ratified the appointment of the petitioner as Education Officer. It was resolved that the Board of Trustees ratified the appointment of the petitioner as Education Officer as approved by the Chairman.
