JUDGEMENT

(1.) The grievance of the Petitioner is that the Respondent Bank has not permitted the Petitioner to operate a Savings Bank Account bearing S.B. A/C/No. 14376 with the Bank of India, Garden Reach Branch, Calcutta.

(2.) Upon the Petition being received, on 8th March, 2007 an order was made permitting the Petitioner to withdraw a sum of Rs. 1 lac in view of the pressing medical needs of the Petitioner.

(3.) An affidavit-in-opposition has been filed on behalf of the Bank citing the instruction given by the Petitioner to the Bank that the operation of the account should not be permitted without the Petitioner's signature.
