(1.) HEARD the learned Advocates appearing for the parties.

CHALLENGING the judgment and order dated 30th November, 2007 passed by the West Bengal Land Reforms and Tenancy Tribunal in original Application No. 1761 of 2006 (LRTT), this writ application has been filed. The issue involved in the Original Application was the challenge of the order passed by the Appellate Authority under Section 54 of the West Bengal Land Reforms Act, 1955 in Appeal Case No. 85 (T)of 2003, whereby the Appellate Authority rejected the application under section 5 of the Limitation Act seeking condonation of delay in preferring the appeal. The order of Appellate Authority is quoted by the learned tribunal below in the impugned order. The order of the learned Tribunal under challenge reads such: -

ASSAILING the order of vesting, an appeal was preferred to the appellate Authority along with the application under Section 5 of the limitation Act, wherein in Paragraph-7 it was categorically contended by the writ petitioners as appellants therein that the appeal was filed annexing the certified copy of the order supplied on 28th October, 2002.
