JUDGEMENT

(1.) This Second Appeal is directed against the judgment of reversal passed by the learned Assistant District Judge, Howrah on 31st January, 1996 in Title Appeal No. 169 of 1994 reversing the judgment and decree dated 23rd June, 1994 passed by the learned Munsif, 7th Court at Howrah in Title Suit No. 18 of 1991, at the instance of the plaintiff/appellant.

(2.) The facts leading to the filing of the instant Second Appeal are summarized hereunder as follows:

(3.) Originally the suit premise was owned by the father of the plaintiff No. 2. On the death of the father of the plaintiff No. 2 all the plaintiffs jointly inherited the suit premises by way of succession. The plaintiffs, thus, are the owners of the suit property.
