JUDGEMENT

(1.) This an application filed by the applicant with the following prayer:-

(2.) A prayer has been made by the applicant in this application for modifying/varying/recalling of a judgment and order dated June 11, 2018 passed in the above writ application. The above writ application was filed in the nature of public interest litigation and the applicant was a party to the above proceeding.

(3.) The case of the petitioner in the above writ application was that the Directorate of Social Welfare, Andaman and Nicobar Administration had been given an amount of Rs. 147 lakhs between the year 1999 to 2002 as National Programme for Rehabilitation of Person with Disability Scheme in Andaman and Nicobar Islands earmarked for the disability persons for these islands. But the said amount was allegedly utilized for that purpose. According to the petitioner diversion/misappropriation of the above fund was at the instance of the public servants and as a result no step was taken with regard to the complaints lodged against the diversion/misappropriation of the above funds.
