(1.) Conviction of the Appellant was recorded under section 326 of the Indian Penal Code and he was directed to suffer imprisonment for a period of five years and to pay a fine of Rs. 2,000/-, in default to suffer imprisonment for six months more.

(3.) Mr. Anwar Hossion, appearing as Amicus Curiae submitted that the versions of the prosecution witnesses are improbable and do not inspire confidence. He also submitted that there is divergence between the evidence of the eyewitnesses and the medical witnesses.
