JUDGEMENT

(1.) The challenge in the present revisional application is at the instance of the defendants in a suit for permanent injunction restraining the defendants/petitioners from disturbing the peaceful possession of the plaintiff over the suit property.

(2.) In the said suit, the plaintiff/opposite party filed an application for an ad interim injunction in the same tune as the relief of permanent injunction in the suit.

(3.) The trial court refused ad interim injunction only on the premise that the plaintiff had started construction about 1 years after obtaining sanctioned plan.
