JUDGEMENT

(1.) The appellant was convicted for commission of offence punishable under Section 376 of the Indian Penal Code and he was sentenced to suffer imprisonment for 7 years and to pay a fine of Rs.2,000/-, in default, to suffer simple imprisonment for 15 days more.

(2.) Nobody appears for the appellant. Md. Anwar Hossain appearing as amicus curiae submits that evidence of the victim is contradictory as to the date of occurrence. He also submits that her evidence suffers from lack of corroboration from other witnesses.

(3.) Ms. Zareen N. Khan along with Ms. Mirza Foroj Ahmed Begg appearing for the State submits that version of the victim was supported by eyewitnesses 6 and 9. It is also submitted that the medical expert, PW 3, who deposed that the victim had been subjected to forcible sexual intercourse.
