JUDGEMENT

(1.) Admittedly the petitioner/appellant/applicant was not a sponsored candidate for the post of Primary School Teacher in the year 2006 when the selection process for filling up the vacant post of Primary Teacher was initiated. Vacancies in the Primary School Teachers were notified to the Employment Exchange on 9th January, 2006.

(2.) Though the selection process was initiated in 2006 but selection test could not be held till October, 2009 for various reasons. The writ petitioner/appellant/applicant filed a writ petition being W.P. No.9242 (W) of 2008 (first writ petition) before the Writ Court praying for issuance of writ of mandamus upon the concerned authority for allowing him to participate in the selection process. He claimed that he was otherwise eligible for the said post.

(3.) The said writ petition was ultimately disposed of by the Writ Court with the following directions:-
