JUDGEMENT

(1.) This matter has come up in the list upon mentioning to apprise the Court to give relief to the petitioner pursuant to the order dated 17th April, 2015 of the Division Bench, the relevant portion of which is being set out hereunder :

(2.) Heard the learned Counsel for the respective parties. Learned Counsel representing the respondent bank prays for some protection so that in the event of success on their part, the money which is supposed to be released under the order of the Court, can be recovered by the bank.

(3.) Now perusing the order dated 11th February, 2015 of this Court passed in G.A. No.166 of 2014 and the above quoted order passed by the Division Bench and since due to pre-occupation of this bench the matter could not be taken up for hearing, disposal within a reasonable time and since this Bench will be demitting Court and office on 9th February, 2018 there would be hardly any scope to fix up this matter for hearing and disposal at an early date. Therefore, liberty is given to the writ petitioner with direction upon the respondent bank to disburse 50% of the interest amount accrued over the principal lying deposited on account of Employers' Contribution to his Provident Fund and Gratuity in the respondent bank, of course on approach by the writ petitioner within a period of two weeks from date.
