JUDGEMENT

(1.) These appeals and cross-objections were taken up together as the lands covered by the acquisitions involved herein are adjoining. We, however, first propose to take up F.A. No.266 of 2002 with its cross-objection.

(2.) This first appeal being F.A. No.266 of 2002 is at the instance of the State of West Bengal and is directed against the award dated 2nd March, 2000 passed by the learned Judge, L.A. Tribunal, Howrah in L.A. Misc. Case No.6 of 1998 by which the award passed by the Collector was enhanced by calculating the price of the lands at the rate of Rs.15,000/- per cottah. The Collector awarded compensation at the rate of Rs.5,500/- per cottah.

(3.) It appears that the lands owned by the referring claimant along with the lands of his other co-sharers were acquired by the State Government for construction of the Kona Truck Terminal. The Collector, as mentioned above, awarded the compensation at the rate of Rs.5,500/- per cottah.
