(1.) This writ petition is directed against the refusal of the respondents authorities to consider the case of the son of the petitioner for compassionate appointment to the post of a primary school teacher.

On and from 16th February, 1996, that is, about a month and a half before the petitioner attained the age of 58 years the petitioner made an application for voluntary retirement on medical grounds. The petitioner also requested the concerned respondents to consider the case of the petitioner s son, Karali Prosad Ghosh, for compassionate appointment.
(3.) When a teacher applies for voluntary retirement and is allowed to retire at least two years before attaining the age of superannuation, one of his children might be considered for compassionate appointment subject to the criteria specified in the said rule. In other words, a ward might only be considered for compassionate appointment if the family of the retired teacher is in acute financial hardship.
