JUDGEMENT

(1.) The revisional application under Section 401 read with Section 482 of the Code of Criminal Procedure is directed to quash proceeding in connection with Sessions Case No. 1(6)05 corresponding to Sessions Trial No. 2(4)06, now pending before the Court of learned Additional Sessions Judge, Fast Track 2nd Court, Barrackpore under Section 498A/306 of the Indian Penal Code.

(2.) The petitioner herein is arrayed as an accused in connection with the said case as mentioned above.

(3.) It appears from the certified copy of the order that petitioner moved an application praying for an order of discharge before the learned Court below but the same was rejected by the said Court. Learned Court below, further, framed charge against the petitioner for commission of offence punishable under Section 498A/306 of the Indian Penal Code to which the petitioner pleaded not guilty. Learned court below also fixed dates for evidence.
