BARUN CHAKRABORTY Vs. STATE OF WEST BENGAL

Decided On April 16, 2008
BARUN CHAKRABORTY Appellant
V/S
STATE OF WEST BENGAL Respondents

JUDGEMENT

(1.) The five petitioners in this writ petition dated June 21st, 2005 are questioning the decisions of the Chairman, Gram Panchayat Staff Recruitment Committee, Simlapal Development Block & Sub-Divisional Officer, Khatra, Bankura. Claiming that they were appointed by Laxminagar Gram Panchayat, Bankura as casual workers, and that having worked for a long period and in view of the government circular, though they were entitled to get permanent employment, the authorities were not taking necessary steps for the purpose, they moved this court by filing writ petitions which were disposed of by orders dated March 24th, 2005 directing the authority giving the impugned decisions to give reasoned decisions treating those writ petitions as their representations. This is how the impugned decisions have come to be given.

(2.) Counsel submits that without giving any reason the authority rejected the petitioners claims that they were entitled to get permanent employment in the Gram Panchayat. I am unable to agree with him. Sufficient reasons have been given by the authority in support of his decisions. After examining the original resolution books, he found that no resolution was ever adopted to engage the petitioners as casual workers in the Gram Panchayat. He concluded that there was no reason for saying that by working casually the petitioners became entitled to get permanent employment.
