JUDGEMENT

(1.) Three applications are taken up for hearing.

(2.) The first is the application of the plaintiff decree-holder in execution of the appellate decree dated 26th June, 1996, by way of tabular statement. The constituted attorney of the decree-holder has filed an affidavit in support of said tabular statement. By the said appellate decree the defendant judgment-debtor, now deceased, was directed to deliver up vacant and peaceful possession of the shop-room at premises No. 7/1A Lindsay Street, Calcutta, more fully described in the schedule thereto. ("The subject shop-room" for short).

(3.) The defendant thereupon applied for leave to appeal from the said appellate decree by way of special leave petition before the Supreme Court. The Supreme Court by its order dated 16th Aug., 1996, was pleased to dismiss the said special leave petition of the defendant. A copy of the said order of the Supreme Court is an annexure to the said affidavit in support of the said tabular statement.
