JUDGEMENT

(1.) The application for amendment which is filed in Court today with copy to the other side is heard and allowed.

(2.) The instant writ petition was moved challenging, the impugned order of vesting dated Aug. 10, 1984, passed by the Revenue Officer, Barasat Settlement 'C' Camp No. 1, Barasat, 24-Parganas (North), being respondent No. 2, under section 5 A(3) (ii) of the West Bengal Estates Acquisition Act, 1853, whereby, 11.41 acres of agricultural land, the present writ petitioner, who is admittedly, a "Transferee" was directed to be vested, in terms of the said order, as per schedule of the said order.

(3.) The present writ petition was moved on Jan. 7, 1986 and the hearing of this writ petition has been fixed by me, on Dec. 1, 1986, when I have directed the learned Advocate for the writ petitioners to serve a 'special notice' in the office of the learned Government Pleader, whereupon, Mr. Anadi Banerjee, learned Advocate is appearing on behalf of the respondents and files an affidavit-in-opposition affirmed on April 29, 1987.
