NIRMAL CHANDRA Vs. UNION OF INDIA

JUDGEMENT

(1.) The order of transfer dated Aug.. 28. 1986. of the petitioner, Nirmal Chandra Sengupta, which is Annexure'B' to the writ petition, from the post of Divisional Manager C.S.O., Calcutta of IISCO to Chasnalla Collieries, has been impugned in the present writ petition.

(2.) By the said order of transfer, the petitioner was to report to Deputy General Manager (Collieries) Chasnalla and functionally to the Asstt. General Manager (S). Calcutta, and his duties and responsibilities was directed to include organising sales and disposals of colliery arisings, such as. low volatile rejected coal from Ramnagore and middlings, rejects, slurry and minus 6 mm. fractions from Chasnalla.

(3.) The instant writ petition being moved on Sept. 1. 1986, stay was granted by U.C. Banerjee, J. of this Court and ultimately the writ petition came up for early hearing for disposal before me on Aug. 28, 1987, in presence of all the parties, as mentioned by the learned Advocate for the respondents for early hearing.
