JUDGEMENT

(1.) Let affidavit-in-opposition filed by the learned Counsel representing the opposite parties/defendants and reply thereto filed by the learned Counsel representing the petitioner/plaintiff be kept on record.

(2.) Heard Mr. Nitai Chandra Saha, being assisted by Mr. Santanu Barik, learned Advocate representing the petitioner and also heard Mr. Nirmalya Pal, being assisted by Ms. Rina Banerjee, learned Advocate representing the opposite parties.

(3.) The instant application, being CO 2659 of 2016 has been directed assailing the order No. 100 dated June 20, 2016 passed by the learned Civil Judge (Senior Division), 6th Court at Alipore in Title Suit No. 97 of 2013 rejecting on contest the application filed by the petitioner proposing amendment in the plaint with cost of Rs. 14,000/- (fourteen thousand) only in all.
