JUDGEMENT

(1.) The Court : Although the report filed by the SI of Mohammadbazar PS, Birbhum dated 21st July, 2017 shows that the said officer made several raids at the residence of the judgment debtors to execute the warrant but the warrantees were not found and they were absconding, however today both the judgment debtors appeared through their counsel. The said appearance of the judgment debtors are treated as surrender to Court.

(2.) The judgment debtor no.1 during his undertaking has stated that the judgment debtors were informed about the warrant by the local police station and only once an officer of the concerned police station visited the said place which contradicts the communication made by SI Tubai Bhowmick.

(3.) The jurisdictional superintendent and the officer in charge of the local police station are directed to enquire into the matter and file a report in this regard by the adjourned date.
