SUHRID MUKHERJEE Vs. UNION OF INDIA

JUDGEMENT

(1.) This writ petition has been filed by the writ petitioner claiming reliefs qua his father, one Mr. H. S. Mukherjee, being the Director of a Company by the name and style of M/s. Modern Transportation Consultancy Services Pvt. Ltd. (for short the Company).

(2.) The petitioner claims the relief of release from civil prison of his father who, is presently said to be 82 years of age and, committed to prison for a period of six weeks by order of the Recovery Officer, Regional Provident Fund Authority (for short RPFA), Kolkata dated 10th March, 2017.

(3.) Mr. Subrata Roy Karmakar, Learned Counsel appears for the petitioner and submits that flowing from the 7A proceeding initiated under the Employees' Provident Funds & Miscellaneous Provisions Act, 1952 (for short the 1952 Act), the RPFA issued a Distress Warrant (for short DW) for alleged non-liquidation of the PF amount.
