JUDGEMENT

(1.) This is an appeal by the husband.

(2.) It is from an order dated 30th April, 2007 passed by the Additional District Judge, Fast Track Court-2, Kalyani, Nadia granting a decree for judicial separation. The learned Judge came to a specific finding that the respondent had mentally tortured the appellant and according to the provisions of law entitled to dissolution of marriage by a decree for divorce. However, the learned judge felt that such a decree was very harsh and instant made a decree for judicial separation.

(3.) The husband appealed against that decree claiming that he was entitled to a decree for dissolution of marriage. That appeal has come up for consideration before us today.
