JUDGEMENT

(1.) This appeal will be heard.

(2.) Lower court's record need not be called for. Since the respondents are represented by their learned advocate, Mr. Verma, service of notice of appeal upon the respondents is dispensed with.

(3.) After the appeal was admitted when the application for stay filed in connection with the appeal was taken up for hearing, we were requested by the learned counsel appearing for the parties to dispose of the appeal itself on merit.
