Having heard the learned advocates for the parties and upon perusing the instant application and in the facts and circumstances of the instant case, we allow the instant application by granting the applicant's leave to prefer an appeal against the order dated 10th November, 2017, passed by the learned Single Judge in WP 23470 (W) of 2017 (Debabrata Khatua & Ors. vs. The State of West Bengal & Ors.).

(3.) The application is accordingly allowed.
