(1.) By consent of the parties, the appeal is treated as on day's list and taken up for consideration along with the connected application.
(2.) During the course of hearing, the learned advocate appearing on behalf of the appellants submits that her clients are willing to withdraw the appeal if the amount of Rs.62,76,875/- which is lying with West Bengal Housing Infrastructure Development Corporation Limited (for short 'HIDCO') is refunded to them.
(3.) Learned senior counsel representing HIDCO submits that his clients are ready and willing to refund the said amount provided the cheque, which was handed over to the appellants in the year 2012, is returned.
