JUDGEMENT

(1.) By consent of the parties, the appeal is treated as on day's list and taken up for consideration along with the application for stay.

(2.) The instant appeal arises out of a judgment and order dated 19th September, 2016, passed by the learned Single Judge in WP 12429 (W) of 2016 (B. Garden Krira Samity & Anr. vs. Howrah Municipal Corporation & Ors.). By the said judgment and order, the learned Single Judge was pleased to dispose of the writ petition as follows:

(3.) The appellants before us are the Executive Engineer (Design), Borough-VI, Howrah Municipal Corporation; Howrah Municipal Corporation, through its Commissioner; the Chairman, Borough-VI, Howrah Municipal Corporation and the Assistant Engineer, Borough-VI, Howrah Municipal Corporation.
