JUDGEMENT

(1.) Leave is granted to the learned advocate-onrecord of the appellant to remove the defect in the memorandum of appeal in the light of the report of the Stamp Reporter.

(2.) This first miscellaneous appeal is directed against an order being No.11 dated 20th June, 2016 passed by the learned Additional District Judge, 1st Court, Serampore, Hooghly in Insolvency Case No. 17 of 2015 at the instance of the appellant.

(3.) By the impugned order, the order of attachment of the defendant's savings bank account being SB A/C. No.34680972194 in the State Bank of India, Garden Reach Branch was vacated by the learned Trial Judge by holding that the said bank account of the defendant/debtor being his pension account cannot be attached in view of the provision contained in Section 21 of the Provincial Insolvency Act, 1920 read with Section 60 of the Civil Procedure Code.
