JUDGEMENT

(1.) By consent of the parties, the appeal and the application are taken up for hearing together and the same are treated as on day's list.

(2.) Admittedly, the writ petitioners/appellants were the licensee in respect of premises at Durgapur under the appellants herein. The licence stood expired by efflux of time. The parties have already approached the Arbitrator for resolving their disputes as regards the status and character of occupation of the writ petitioners/respondents in the premises in question. The arbitral proceeding is still pending for consideration before the learned Arbitrator.

(3.) Pending disposal of the arbitration proceeding, the supply of electricity to the writ petitioners/respondents was disconnected by the appellants (licensor). The writ petitioners/respondents approached the writ court for restoration of the supply of electricity.
