JUDGEMENT

(1.) This application has been filed in connection and/or in continuation of the main writ petition. The petitioner/applicant has challenged the charge-sheet issued to him dated 2/1/1998, finding of the Inquiry Officer dated 20/8/1998 and the final order of dismissal dated 21/1/1999 passed in the disciplinary proceeding initiated against the petitioner/employee of Railway Protection Force, Eastern Railway, Howrah along with the appellate order dated 1/3/1999. The fact as made out in this application is inter alia as follows :

(2.) The petitioner is a Constable and has joined the service under Railway Protection Force in Sept., 1989. Since then he has been working as Constable of RPF attached to the Eastern Railway, Howrah.

(3.) On 19th Sept., 1993 the petitioner was detailed for Telephone Attendant and Malkhana guarding duty in the RPF Inspector's Office. The petitioner alleged that he is a member of the RPF and not a member of GRP. The petitioner's duties and functions had been laid down under Sec. 11 of the RPF Act and clause 41.1 and 41.2 of the RPF Rules, 1987.
