JUDGEMENT

(1.) This is an appeal against Order No. 20 dated January 27, 1988 passed by the learned Assistant District Judge, Second Court at Alipore, District 24-Parganas, in Title Suit No. 6 of 1987.

(2.) By the order impugned the learned Trial Judge allowed an application filed by the defendant in the suit under Order 7, Rule 10 read with Section 151 of the Code of Civil Procedure. The learned Trial Judge directed return of the plaint to the plaintiff, inter alia, for presentation of the plaint in the appropriate Court in Delhi in terms of Clause 22 of the agreement dated May 19,1978.

(3.) Being aggrieved the plaintiff has come up with this appeal.
