JUDGEMENT

(1.) THE appellant Sambhu Nath Samaddar and another were tried and convicted under Section 7 of the prevention of Corruption Act, 1988 read with Section 34 of the Indian Penal Code as well as under Section 13 (l) (d) read with section 13 (2) of the Prevention of Corruption act read with Section 34 of the Indian penal Code and were sentenced to suffer rigorous imprisonment for 2 years and to pay a fine of Rs. 5,000 in default rigorous imprisonment for 3 months and to suffer rigorous imprisonment for 3 years and pay a fine of Rs. 5,000 and in default to suffer rigorous imprisonment for 3 months respectively in a trial held before the Special Court, 24 Parganas, South at Alipore. While the appellant challenged his order of conviction and sentence in the instant appeal the other convict Arun Kumar bhattacharya challenged the same in criminal Appeal No. 110 of 2001.
