JUDGEMENT

(1.) The Court :

(2.) It appears that a total claim against the writ petitioner/appellant herein was for a sum of Rs. 49,43,717.90 together with an equivalent penalty, and a further penalty of Rs. 5 lakhs imposed upon the Vice-President of the company and Rs. 2 lakhs on the Executive Branch Manager.

(3.) The writ petitioner/appellant herein preferred an appeal and applied for stay as also dispensation of any deposit as a pre-condition to the admission of the appeal. The learned Tribunal directed the appellant/writ petitioner herein to deposit a sum of Rs. 10 lakhs and subject to the deposit of the said amount the recovery of the balance amount of duty and penalty was stayed. The writ application was filed against the said order. This appeal is a product of the said writ petition.
