JUDGEMENT

(1.) This second appeal is directed against judgment and decree dated 16.7.1996 passed by the learned Assistant District Judge, Diamond Harbour, 24 Parganas (South) in Title Appeal No. 76 of 1994.

(2.) The said appeal was preferred by the present appellants against judgment and decree passed by the learned Munsif, First Additional Court at Diamond Harbour in connection with Title Suit No. 5 of 1990.

(3.) That was a suit brought by the present respondent against the present appellants for declaration of title and injunction. The plaintiff in that case prayed for declaration that the impugned deed of gift dated 29.11.1986 allegedly executed by the plaintiff in favour of the defendant Nos. 1 to 4 in respect of property in question is void.
