JUDGEMENT

(1.) Although this Rule has a chequered background. the point involved in it is a very short one.

(2.) The petitioner instituted a suit against the opposite party, being Title Suit No. 12 of 1984, in the 2nd court of the learned Munsif at Alipore inter alia for declaration that the opposite party is, not his wife and that the registration of the marriage between them under section 8 of the Hindu Marriage Act is bad in law.

(3.) Summons was sent to the opposite party through court as well as by registered post.
