JUDGEMENT

(1.) The learned Judicial Magistrate, Islampur, framed charge under section 7(l)(a)(ii) of the Essential Commodities Act. The petitioners assail this framing of charge and has filed this revisional application.

(2.) Mr. P.K. Roy, the learned advocate has appeared for the petitioner. Mrs. Dipty Mitra, the learned advocate has appeared for the State.

(3.) Mr. Roy appearing for the petitioner has raised three contentions. His first contention is that the search in this case could not be conducted by the authorities not being Police Officers. It is not necessary to dwell much on this point as from the F.I.R. itself it appears that the search was conducted by Shri B.P. Ghosh, Inspector of Police. Indeed, when this was pointed out Mr. Roy withdrew his point.
