Opposite Party This revisional application is directed against an order dated 12th June, 2015 passed by the trial Judge in connection with an application under Sections 7(1), 7(2) and 7(3) of the West Bengal Premises Tenancy Act, 1997 (hereinafter referred to as the said Act) along with a petition under Section 5 of the Limitation Act read with Section 7(3) of the said Act.
(2.) In a suit for eviction instituted by the plaintiff, the defendant entered appearance in the suit on 2nd February 2008. Thereafter the suit was fixed for filing written statement. On 20th August, 2013 the plaintiff filed a petition under Section 7(3) of the said Act in view of the fact that the defendant did not comply with the provisions of Section 7(1) and Section 7(2) of the West Bengal Premises Tenancy Act. It is only thereafter on October, 2013 three petitions were filed by the petitioner, namely, petitions under Section 7(1) and 7(2) accompanied with an application under Section 5 of the Limitation Act.

The petition under Section 7(1) is a one line petition without offering any explanation for not being able to deposit the rent within the prescribed period of one month from the date of entering appearance nor any explanation was offered for not being ale to deposit the admitted rent along with arrears till the date of filing of the aforesaid petitions.
