JUDGEMENT

(1.) When this petition was received during the summer vacation, an order was made on May 31, 2016 permitting the petitioner to indicate to the employer whether the petitioner would prefer to be posted in any nearby unit in the State of West Bengal or in the State of Assam. Such indulgence was shown to the petitioner in view of the serious ailment suffered by the petitioner's daughter.

(2.) The petitioner claims to have written a letter dated June 1, 2016 to the employer, which the Central Reserve Police Force claims not to have received till date. A copy of the relevant letter has been produced in court together with the tracking report of the India Post that the postal article had been delivered at the Lodhi Road, New Delhi head office of the CRPF.

(3.) The letter refers to several places in or around Siliguri and it is evident that the petitioner does not wish to travel beyond Matigara which is now considered to be a part of Siliguri. CRPF says that there are vacancies available to the petitioner in Durgapur or in or around Guwahati in the State of Assam. According to the employer, the petitioner cannot be permitted to continue at or around his present place of posting of Siliguri since he has spent a number of years there.
