(1.) This revisional application is at the instance of the plaintiff in Ejectment Suit No. 6720 of 2014 pending before the learned Judge, 4th Bench, Small Causes Court at Calcutta. The grievance of the petitioner is that due to various dilatory tactics adopted by the defendantsopposite parties the learned Court below is yet to dispose of the application filed by the defendants-opposite parties under Section 7(2) of the West Bengal Premises Tenancy Act, 1997. Mr. Banerjee, learned advocate appearing for the petitioner produced the order dated August 9,2016 passed by the learned Court below allowing the prayer of the defendants-opposite parties for adjournment of the said application. Mr. Banerjee further submitted that the ejectment suit is otherwise ready for hearing and even the learned Court below has framed issues and the trial of the suit cannot commence during pendency of the said application of the defendants-opposite parties. The petitioner has prayed for early disposal of the said application filed by the defendants-opposite parties at an early date.
(2.) Considering the facts of the case and the materials on record, this Court is of the view that the petitioner is entitled to obtain an order as prayed for in this revisional application. Accordingly, the learned Judge, 4th Bench, Small Causes Court at Calcutta is requested to dispose of the application filed by the defendants-opposite parties under Section 7(2) of the West Bengal Premises Tenancy Act, 1997 as expeditiously as possible, preferably within September 23,2016 without granting any unnecessary adjournment to either of the parties and subject to the convenience of the business of the Court.
